Overview

Welcome to Boring Foods. Throughout these Terms of Service, “Boring Foods,” “we,” “us,” and “our” refer to the business operating boringfoods.com.

We offer specialty snacks, candy, chocolate, and other food products for personal enjoyment, sharing, business use, and bulk purchasing. Our website, store, content, and related services are collectively referred to as the “Services.”

Our store is powered by Shopify.

These Terms explain the conditions for using our Services and purchasing from us. By using the Services or placing an order, you agree to these Terms and the policies incorporated into them. If you do not agree, please do not use the Services or place an order.

Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited.

1. Access and Accounts

You must be legally able to enter into a binding contract to place an order. If you are using the Services on behalf of a business, you confirm that you are authorized to act for that business.

You agree to provide accurate and current account, billing, payment, contact, and shipping information.

If you create an account, you are responsible for protecting your login credentials and notifying us promptly of unauthorized access. You may not impersonate another person or use someone else’s payment information without authorization.

2. Products, Ingredients, and Allergens

We aim to provide accurate product descriptions, photographs, package sizes, quantities, and other important product information.

Packaging, formulations, ingredients, and manufacturer labeling may change. Product photographs are illustrative, and colors may appear differently on different screens. These variations do not remove your right to receive products that match the material description provided when you ordered.

Always read the product’s actual packaging, ingredient list, allergen information, and preparation or storage instructions before consuming it.

Do not assume a product is free from a particular allergen unless that claim is expressly supported by its labeling. Products may contain allergens or carry manufacturer warnings about shared equipment or facilities.

If the product you receive has information that materially differs from our listing, or if you have concerns about an ingredient, allergen, or label, contact hi@boringfoods.com before consuming it.

Product availability may change. We may discontinue products or apply reasonable purchase limits, including limits needed to manage stock, prevent fraud, or comply with legal requirements.

3. Orders, Bulk Purchases, and Business Use

Placing an order is an offer to purchase the products selected at checkout. An automatic order acknowledgment confirms receipt of your order; it does not guarantee that every item is available or that the order has been accepted.

We may decline or cancel an order for reasons such as unavailable inventory, suspected fraud, payment failure, an ineligible shipping address, a material listing error, or legal restrictions. We will notify you and refund amounts paid for any items we cannot supply.

Boring Foods welcomes personal, bulk, and business purchases. These Terms do not impose a general prohibition on lawful resale of purchased products.

Business customers are responsible for the permits, tax requirements, storage practices, labeling obligations, and other legal requirements applicable to their own business activities. Any repackaging or resale must comply with applicable food laws and must not misrepresent the product, its origin, or an affiliation with Boring Foods or its manufacturer.

Package sizes, case quantities, weights, and counts are those stated in the relevant product listing. A purchase described by weight does not guarantee a particular piece count unless the listing expressly states one.

Separate written wholesale or business agreements, where applicable, may contain additional terms.

4. Prices, Promotions, and Payment

Prices, available discounts, and promotional offers may change. The applicable currency, product prices, shipping charges, taxes, and order total are shown at checkout.

Changes to our published prices do not automatically change the price of an order we have already accepted.

Promotions may have separate eligibility requirements, exclusions, quantities, or expiration dates. Those conditions will be disclosed with the offer.

You agree to provide valid payment information and authorize us and our payment providers to process the amount shown at checkout.

If a material pricing or listing error affects your order, we will contact you. We will not charge a higher price or make a material substitution without your agreement. If the order cannot proceed, we will refund the affected payment.

5. Shipping and Delivery

We ship to continental U.S. states only. We do not ship to Alaska, Hawaii, U.S. territories, or international addresses.

Our standard shipping charges are:

• Free shipping on orders over $70.

• $10 shipping on orders of $70 or less.

The shipping charge applicable to your order is displayed at checkout.

Please check your shipping address carefully before submitting your order. Contact hi@boringfoods.com immediately if you discover an error. Address changes may not be possible after fulfillment begins.

Shipping and delivery estimates are estimates unless we expressly offer a guaranteed service. Carrier delays, weather, and other disruptions may affect delivery.

If we cannot ship within the promised shipping timeframe, we will provide the notices and cancellation or refund options required by applicable law, including obtaining agreement to a shipping delay where required.

If your package is missing, arrives damaged, or is marked delivered but cannot be located, contact us promptly so we can investigate and explain the available resolution. We will not require you to resolve every delivery issue with the carrier yourself.

6. Food Storage, Dates, and Heat-Sensitive Products

Store products according to their packaging instructions. Many snacks require a cool, dry location away from direct sunlight.

Chocolate and other heat-sensitive products may soften or melt during warm weather. If your order arrives melted, damaged, or otherwise compromised, contact hi@boringfoods.com with your order number and photographs, if available. We will review the issue under our Refund Policy and applicable law.

A heat-related issue is not automatically excluded from review.

Products may display manufacturer date markings such as “best before,” “best by,” or “use by.” Follow the wording and instructions on the actual packaging. A lot or batch code is not necessarily an expiration date.

Where we offer products specifically as short-dated or past a stated quality date, that condition should be disclosed in the listing before purchase.

Do not consume a product if its packaging is compromised, it appears spoiled, or you have a reasonable safety concern. Contact us about the issue and retain the packaging and lot information where possible.

7. Returns, Refunds, and Cancellations

Food returns and refund requests are governed by our Refund Policy.

Because we sell food, we generally do not accept returns for a change of mind, personal taste preferences, or an incorrect selection made by the customer. This does not exclude remedies for damaged, defective, unsafe, missing, or incorrectly supplied products, or other remedies required by law.

Please do not send food products back without contacting us first.

To request an order cancellation or change, email hi@boringfoods.com as soon as possible. We will try to help before fulfillment begins, but changes or cancellations may not be possible once an order is being packed or has shipped.

These operational limits do not override cancellation or refund rights provided by applicable law.

8. Intellectual Property

The Boring Foods name, our original website content, graphics, designs, and other materials belong to us or our licensors and are protected by applicable intellectual property laws.

Third-party product names, trademarks, packaging designs, and logos belong to their respective owners.

You may use the Services to browse, shop, and manage purchases for personal or lawful business purposes. You may not copy, distribute, sell, or exploit our website content or branding without permission, except as allowed by law.

Permission to purchase or lawfully resell products does not grant permission to present yourself as Boring Foods or imply an endorsement or partnership that does not exist.

9. Relationship With Shopify

Boring Foods is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Boring Foods.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Boring Foods, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Boring Foods, to the extent permitted by applicable law.

10. Privacy

Our collection and use of personal information are described in our Privacy Policy.

Shopify also processes certain personal information to operate and support the store. Its practices are described in the Shopify Privacy Policy.

Depending on the services involved, personal information may be processed by service providers or transferred across borders as described in the applicable privacy policies.

11. Reviews, Feedback, and Submitted Content

You may submit reviews, suggestions, photographs, or other content where the Services allow.

You retain ownership of your submitted content. By submitting content intended for public display, you grant us a non-exclusive, worldwide, royalty-free license to reproduce, display, and use it in connection with operating and promoting the Services, subject to applicable law.

This license does not transfer ownership of your review or authorize us to publish private customer-service correspondence or personal information without an appropriate legal basis.

Your submissions must reflect your genuine experience. You must have permission to use any content you submit and disclose relevant incentives or relationships where required.

We may moderate content containing unlawful material, private information, harassment, impersonation, spam, or material unrelated to the product or shopping experience.

We will not prohibit, penalize, or remove an honest review merely because it is negative.

12. Errors and Corrections

Occasionally, the Services may contain an error involving a product description, price, promotion, quantity, availability, or shipping estimate.

We may correct those errors. If an error materially affects an existing order, we will contact you and explain the available options.

We will not use this section to change an accepted order’s material terms without your agreement or to avoid a refund or other remedy required by law.

13. Acceptable Use

You may use the Services only for lawful purposes.

You must not:

• Commit fraud, impersonate another person, or provide knowingly false information.

• Use stolen or unauthorized payment information.

• Harass, threaten, or unlawfully target customers, staff, or others.

• Upload malware or interfere with the security or operation of the Services.

• Infringe intellectual property, privacy, or other legal rights.

• Send spam or manipulate reviews, promotions, or purchasing systems.

• Circumvent access controls or engage in unauthorized automated collection of information.

• Copy or resell the Services themselves without authorization.

This section does not prohibit lawful resale of purchased products as described in Section 3.

14. Automated Agents

An “Agent” is autonomous or semi-autonomous software acting on behalf of a user.

Agents may access the Services only through permitted interfaces and must comply with these Terms, applicable access restrictions, and reasonable technical limits.

An Agent must identify itself accurately when requested and must not conceal its automated nature, impersonate a human, bypass CAPTCHA or other security controls, or circumvent purchasing limits.

Where an interface requires an identifying user-agent header, the Agent must provide an accurate identifier, such as “Agent/[agent name].”

We may restrict or suspend Agent access where necessary to protect the Services, customers, or inventory.

Users remain responsible for orders and other actions they authorize an Agent to perform on their behalf.

15. Optional Tools and Third-Party Links

The Services may include third-party tools, applications, payment options, or links to external websites.

Those providers may have their own terms and privacy policies. We do not control every third-party service or external website, and a link does not necessarily mean that we endorse its content.

Optional third-party tools are provided subject to their availability and applicable terms. Nothing in this section removes our responsibility for our own sales or obligations to you.

16. Suspension and Termination

We may suspend or terminate access to the Services where reasonably necessary because of fraud, unlawful activity, security concerns, a material breach of these Terms, or discontinuation of the Services.

Where appropriate and legally required, we will provide notice.

Suspending access does not remove your rights regarding an existing purchase or allow us to retain payment for an order we cancel without providing a required refund.

Provisions that are intended to continue after termination, including intellectual property rights and applicable payment obligations, will continue to apply.

17. Website Availability and Warranties

We aim to keep the Services accurate, secure, and available, but we do not guarantee uninterrupted access or that every technical error will be immediately corrected.

To the extent permitted by law, the website and optional online tools are provided on an “as available” basis.

This website availability disclaimer does not mean that food products are sold without applicable warranties, food-safety obligations, or rights to receive products matching their material description.

We do not exclude warranties or consumer protections that applicable law does not permit us to exclude.

18. Limitation of Liability

To the extent permitted by law, Boring Foods will not be liable for indirect or consequential losses arising from use of the Services, such as lost profits or business interruption.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including applicable liability for defective or unsafe products, fraud, willful misconduct, or other protected claims.

This section does not limit your rights to a refund, replacement, or other remedy required by law.

19. Indemnification

To the extent permitted by law, you agree to indemnify Boring Foods against third-party claims and reasonable related costs caused by your unlawful misuse of the Services, infringement of another person’s rights through content you submit, or material breach of these Terms.

This obligation does not apply merely because you purchased a product, submitted an honest review, or made a valid complaint. It does not make you responsible for our own misconduct or defective products.

We will provide reasonable notice of a covered claim and reasonable cooperation in its defense. No settlement may impose an obligation or admission on you without your consent.

20. Severability and Waiver

If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

A failure or delay in enforcing a provision does not automatically waive the right to enforce it later.

21. Entire Agreement and Assignment

These Terms, the policies incorporated into them, and any additional terms expressly agreed for a particular purchase form the agreement governing your use of the Services and that purchase.

You may not transfer your account or contractual obligations without our consent, except where permitted by law.

We may transfer our rights and obligations in connection with a business sale, reorganization, or similar transaction, provided that the transfer does not remove your existing rights. We will provide notice where required by law.

22. Applicable Law and Disputes

These Terms and transactions through the Services are subject to applicable law.

Nothing in these Terms removes mandatory consumer protections or requires you to waive rights that cannot lawfully be waived.

Any dispute must be brought before a court or other forum with jurisdiction under applicable law.

23. Headings

Headings are included for convenience and do not change the meaning of these Terms.

24. Changes to These Terms

We may update these Terms to reflect changes to our business, Services, or legal requirements.

Updated Terms will be posted on this page, and we will provide additional notice where required by law.

Changes apply prospectively. An update does not automatically change the terms governing an order already accepted.
